Urteil vom 04.09.2023, Az. 4O100/23
Das Landgericht (LG) Paderborn hat Facebook aufgrund datenschutzrechtlicher Verstöße dazu verurteilt, 400 Euro Schadensersatz nebst Zinsen an unseren Mandanten zu zahlen. Das Erstaunliche an diesem Urteil ist: Es liegt im Bezirk des Oberlandesgerichts (OLG) Hamm, welches am 15.08.2023 (Az. 7 U 19/23) entschieden hatte, dass Facebook zwar gegen die DSGVO verstoßen habe, unser Mandant aber mangels ausreichender „persönlicher bzw. psychologischer Beeinträchtigungen“ keinen immateriellen Schadensersatz geltend machen könne. Uns ist das Urteil des OLG Hamm am 1. September mitgeteilt worden. Die Gegenseite hatte das LG Paderborn am 23.08.2023 sogar noch explizit darauf hingewiesen. Dennoch hat das LG Paderborn abweichend entschieden, also gegen die nächsthöhere Instanz! Das zeigt: Nicht einmal die dem OLG Hamm untergeordneten Gerichte halten sich an diese – unserer Meinung nach juristisch inkorrekte – Entscheidung.
